Terms of Service

These terms are an agreement between you and [COMPANY LEGAL NAME] (“we”) for the Tandem apps for iPhone, Android, Apple Watch and Wear OS, and our website (together, “Tandem”). By installing or using Tandem you accept them. If you do not agree, do not use Tandem.

1. Who can use Tandem

You must be at least 16 and able to form a binding contract. You are responsible for the devices and accounts you connect.

2. What Tandem does — and its limits

Tandem lets a smartwatch and a phone from different makers exchange notifications, controls and data using features those makers allow. Because of that:

  • Some features depend on your devices, software versions, region and settings, and may change when Apple, Google, Samsung or other makers change their software.
  • Your watch must first be activated with its maker’s own phone platform (for example an iPhone for Apple Watch). Some functions, such as watch software updates or payment cards, may still need that phone.
  • Talking on an Apple Watch during calls on an Android phone is not available.
  • Tandem is not an emergency service. Do not rely on it for emergency calls, alerts or safety-critical notifications.
  • Tandem is a wellness tool, not a medical device (see the Consumer Health Data Privacy Policy).

3. Your licence

We give you a personal, non-exclusive, non-transferable, revocable licence to use Tandem on devices you own or control, under these terms and the rules of the store you downloaded it from (including the Apple Licensed Application End User License Agreement where it applies). You may not copy, resell, reverse-engineer (except where the law allows), or use Tandem to break the law or anyone else’s rights.

4. Subscriptions

Paid features are described in our Subscription, Free Trial and Cancellation Terms, which form part of these terms. Purchases are processed by Apple or Google.

5. Your content

Notifications, messages and health data you sync remain yours. You give us only the permissions needed to transmit them, in encrypted form, between your own devices.

6. Trademarks and independence

Apple, Apple Watch, iPhone and Apple Health are trademarks of Apple Inc. Android, Wear OS, Google Pixel and Health Connect are trademarks of Google LLC. Samsung and Galaxy are trademarks of Samsung Electronics. Tandem is an independent product and is not affiliated with, sponsored by or endorsed by any of them.

7. Availability and changes

We work to keep Tandem reliable but do not promise it will be uninterrupted or error-free. We may change or stop features; if we stop a paid feature you have paid for, we will offer a fair remedy.

8. Liability

Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, fraud, or your statutory consumer rights. Otherwise, to the extent the law allows, Tandem is provided “as is” and our total liability to you is limited to the amount you paid us in the 12 months before the claim. We are not liable for missed notifications, calls or data caused by your devices, operating systems, networks or third-party services.

9. Ending these terms

You can stop using Tandem at any time and delete your data in the app. We may suspend or end access if you seriously breach these terms, with notice where reasonable.

10. Law and disputes

These terms are governed by [GOVERNING LAW AND COURTS]. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live and may bring claims in your local courts. EU consumers can also use the EU online dispute resolution options available in their country.

11. Changes to these terms

We will give you notice in the app before material changes take effect. Continuing to use Tandem after that means you accept them; if you do not, you can cancel.
